The federal laws pertaining to wages, working hours, overtime pay and recordkeeping for pay records are part of the Fair Labor Standards Act (FLSA). The FLSA contains a number of regulations concerning hourly, non-exempt employees as well as exempt and non-exempt salaried employees. However, the FLSA does not govern the manner in which employers should record employees' hours worked or the mechanism employers should use to track employees' working hours.
Salary Conditions and Working Hours
Salaried employees receive a fixed compensation rate for a specified number of hours. When a candidate receives a job offer, the employer generally states the salary and the working hours. For example, a recruiter might state during an interview: 'The engineer position you're being considered for is full-time and the pay is $50,000 a year.'
By the time the employer extends an offer, the prospective employee knows the typical working hours but isn't instructed to clock in no later than 8 a.m. and clock out when he leaves the office at 5 p.m. The employer trusts the engineer will put in the minimum 40 hours a week and work additional time as necessary to complete his job duties.
Accountability and Fulfillment of Responsibilities
Whether salaried, exempt or salaried, non-exempt, employers generally hold salaried employees to a higher standard of accountability than hourly employees. Salaried employees are expected to complete their assigned jobs, regardless of the time it takes to fulfill their responsibilities. This alone precludes the use of time clocks for salaried employees.
If an employee works the entire workday and also works at home in the evening, it's not feasible for him to punch a time clock. Performance management is central to the argument about employers who endorse the use of time clocks for salaried employees. Use of a time clock doesn't guarantee strong performance – a time clock records the employee's presence, not necessarily productivity. If an employee doesn't put forth enough effort to be productive, it will ultimately show in her performance appraisals.
Deductions from Pay
According to the FLSA, employers cannot dock salaried workers' pay for less than a full day's absence. Employers may make deductions from salaried workers' pay only for absences that last one day or longer. For example, assume a salaried employee works five hours in the office yet after lunch doesn't feel well enough to stay at work the rest of the day. The hours for which the employee isn't in the office or not working cannot be deducted from his paycheck.
This is another reason time clocks are nonessential for salaried workers: The purpose of a time clock is to record specific hours the employee is on the premises, in the office or held accountable for productivity. Employers expect salaried employees to exercise independent judgment and discretion in their performance of their job duties, which is an expectation that extends to accountability for hours worked.
Record-keeping for Salaried Employees
Time clocks typically are used for recordkeeping purposes. The FLSA doesn't mandate time clocks at all, not even for hourly, non-exempt employees. The FLSA's Fact Sheet No. 21, titled 'Recordkeeping Requirements Under the Fair Labor Standards Act (FLSA)' states: 'Employers may use any timekeeping method they choose.
For example, they may use a time clock, have a timekeeper keep track of employee's work hours or tell their workers to write their own times on the records.' That being said, there exist no federal rules concerning the use of time clocks for salaried employees. It's up to the employer to determine the best system of timekeeping for its employees.
